2 miles of white sand beach: one of Maine's most precious natural resources

This website has been maintained by the Town of Kennebunkport since 2009 to support its on-going efforts to preserve the right of the public to enjoy Goose Rocks Beach in the face of a lawsuit brought against the Town by a few beachfront owners who seek a court order privatizing the beach.

On October 16, 2012, the York County Superior Court ruled in favor of the Town of Kennebunkport, and against the Plaintiff beachfront owners who brought the lawsuit, and found that the public has the right to use Goose Rocks Beach for general recreational purposes.  After a three week trial at which 63 witnesses testified, including most of the Plaintiffs and many others who have been using Goose Rocks Beach for generations, the Court specifically found: “The evidence is clear that and the general public have claimed a right to use the entire Beach, both wet sand and dry sand, for general recreational purposes for approximately one hundred years or more and this use has been open and visible to the Plaintiffs or their predecessors in title.”

We are adding a new transcripts page to the website so that you can review all of the trial testimony, and you can review the Superior Court’s October 16, 2012 decision here.

Plaintiffs recently filed an appeal to the Maine Supreme Judicial Court in hopes of overturning the Court’s decision.  The Town remains committed to preserving the status quo at Goose Rocks Beach so that generations of people from Kennebunkport and beyond can continue to enjoy this precious natural resource in the future in the same way that they have for generations, and so we have added an appeal page to the website so that you can follow the appeal process.  Please check back often for updates on the appeal.

Finally, we would like to thank everyone who contacted us through the website or directly to share your memories and photographs of Goose Rocks Beach.  Your contributions helped us to present evidence to the Superior Court of the historic use of Goose Rocks Beach.
